President signed law on peculiarities of the state policy on ensuring the state sovereignty of Ukraine in the temporarily occupied territories in Donetsk and Luhansk regions

During the meeting of the Military Cabinet, President Petro Poroshenko signed the law on peculiarities of the state policy on ensuring the state sovereignty of Ukraine in the temporarily occupied territories in Donetsk and Luhansk regions.

The Head of State stressed that February 20 would remain in the history of Ukraine forever as a tragic date when the Heroes of the Heavenly Hundred defended our right for the future on February 18-20. He reminded that the military aggression of Russia against Ukraine also started on February 20. “It started with the illegal annexation of Crimea. They even minted medals with the date of February 20,” he said.

“We shouldn’t think that Russia’s goal was Crimea of the east of our state. I am sure that the goal is still the whole Ukraine. Of course, the aggressor didn’t expect the resistance organized from the first days of the aggression by the Ukrainian people, volunteers who ruined the plans elaborated in the top offices of the Kremlin,” the President noted.

“This Law, on the one hand, reflects my strategy on the return of the occupied territories under the Ukrainian sovereignty. In this Law, we qualify the Russian state as an aggressor state. And this is enshrined at the legislative level. In this Law, it is legally determined that it was the Russian Federation that occupied our territories. This Law substantially strengthens the legal basis for the use of the Armed Forces of Ukraine and other forces for the defense of our state,” Petro Poroshenko emphasized.

At the same time, according to him, this Law establishes the basic parameters of protection of civil rights and freedoms of the civilian population. “And it is very important that this Law provides a legal mechanism for the return of these territories. Inter alia, in a political and diplomatic way,” Petro Poroshenko emphasized.

“I would like to say that this Law doesn’t in any way violates any international commitments of Ukraine, including the Minsk agreements, as the Russian Federation is trying to depict that, justifying its reluctance, outright sabotage in the implementation of the Minsk agreements,” the Head of State said.

The Head of State once again stressed the importance of protecting not only the territory, independence and sovereignty of our state, but also its national and economic interests.

“We shouldn’t waste a single opportunity to prepare consolidated claims to the state-aggressor - the Russian Federation,” the President emphasized and instructed Minister of Foreign Affairs Pavlo Klimkin to continue the preparation of claims for the full reimbursement of losses incurred by the aggressor country.

“It is not just the territorial steps of our state, not only political, not only the creation of an international coalition in support of Ukraine, but also the reimbursement of losses. I am confident that we will need to generalize the legal position, in terms of both protecting state interests and compensating the positions of individual departments, state enterprises and private enterprises that have suffered enormous losses as a result of the aggression,” Petro Poroshenko emphasized.

"This law fixes our right to self-defense in accordance with Article 51 of the UN Charter," Petro Poroshenko said, noting that in these circumstances, the leading role in rebuffing the Russian aggression falls on the shoulders of the Armed Forces of Ukraine.

He instructed Minister of Defense of Ukraine Stepan Poltorak and Chief of the General Staff of the Armed Forces of Ukraine Viktor Muzhenko to submit appropriate proposals for the change of format for the implementation of this Law, to propose the candidature of the Commander of the Joint Force, to submit proposals on the Regulations on the Joint Operational Headquarters, to submit the Strategic Plan on the use of the Armed Forces, other forces, to ensure the subordination of the determined forces and means to the Commander of the Joint Forces.

The President also urged all the participants of the meeting, in particular, to Secretary of the National Security and Defense Council Oleksandr Turchynov, Minister of the Interior Arsen Avakov and Head of the Security Service Vasyl Hrytsak to prepare the given regulations for the implementation of this Law, ensure the necessary direct subordination to the Commander of the Joint Force, clarify the decision-making mechanism, expand and specify these steps.
